La loi impose que les crit\u00e8res soient objectifs, donc il faut argumenter sur tout ce qui parait contraire \u00e0 la mission du salari\u00e9 (manque de moyens, difficult\u00e9s structurelles, etc). Il ne faut pas h\u00e9siter \u00e0 mentionner le renvoi \u00e0 un document joint r\u00e9dig\u00e9 au calme, relatant tout ce qui pose probl\u00e8me.<\/p>\n<p>L\u2019\u00e9valuation permet \u00e0 l\u2019employeur de respecter son obligation g\u00e9n\u00e9rale d\u2019adaptation des salari\u00e9s au poste de travail (C. trav., art. L. 6321-1). Le respect de cette obligation conditionne ses d\u00e9cisions en mati\u00e8re de formation professionnelle, de licenciement \u00e9conomique, et de licenciement pour motif personnel.<\/p>\n<p>&nbsp;<\/p>\n<h3>Les IRP doivent-elles \u00eatre consult\u00e9es sur les syst\u00e8mes d\u2019\u00e9valuation professionnelle ?<\/h3>\n<p>La jurisprudence \u00e9tablit que le CHSCT doit \u00eatre consult\u00e9 sur les syst\u00e8mes d\u2019\u00e9valuation professionnelles si:<br \/>\n&#8211; \u201celles doivent permettre une meilleure coh\u00e9rence entre les d\u00e9cisions salariales et l\u2019accomplissement des objectifs ;<br \/>\n&#8211; elles peuvent avoir une incidence sur le comportement des salari\u00e9s, leur \u00e9volution de carri\u00e8re et leur r\u00e9mun\u00e9ration ;<br \/>\n&#8211; les modalit\u00e9s et les enjeux de l\u2019entretien s\u2019ils sont manifestement de nature \u00e0 g\u00e9n\u00e9rer une pression psychologique entra\u00eenant des r\u00e9percussions sur les conditions de travail\u201d. (Cass. soc., 28 nov. 2007, n\u00b0 06-21964)<\/p>\n<p>Suite \u00e0 la disparition du CHSCT des suites de la r\u00e9forme op\u00e9r\u00e9e par l\u2019Ordonnance n\u00b0 2017-1386 du 22 septembre 2017, les comp\u00e9tences en mati\u00e8re de sant\u00e9, s\u00e9curit\u00e9 et conditions de travail de ce dernier ont \u00e9t\u00e9 confi\u00e9es au CSE. \u00c0 ce titre, cette d\u00e9cision doit pouvoir profiter au CSE dans les m\u00eames conditions.<\/p>\n<p>Si \u00e0 l\u2019issue de l\u2019entretien vous vous sentez d\u00e9motiv\u00e9, d\u00e9prim\u00e9, col\u00e9rique ou stress\u00e9,&#8230; bref, perturb\u00e9, allez imm\u00e9diatement \u00e0 l\u2019infirmerie le signaler, mention en sera ainsi port\u00e9e sur le registre des accidents b\u00e9nins ou du travail, en y consignant les causes (v\u00e9rifiez-le ou faites-le v\u00e9rifier).
