{"id":3224,"date":"2016-07-04T23:05:09","date_gmt":"2016-07-04T21:05:09","guid":{"rendered":"http:\/\/ofict.reference-syndicale.fr\/?p=3224"},"modified":"2020-05-29T14:08:12","modified_gmt":"2020-05-29T12:08:12","slug":"lettre-unitaire-a-la-drh-relative-au-groupe-de-travail-du-chsct-temps-et-charges-de-travail","status":"publish","type":"post","link":"https:\/\/syndicoop.fr\/ofict\/lettre-unitaire-a-la-drh-relative-au-groupe-de-travail-du-chsct-temps-et-charges-de-travail\/","title":{"rendered":"lettre unitaire \u00e0 la DRH relative au groupe de travail du CHSCT &#8211; temps et charges de travail"},"content":{"rendered":"<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Madame la Directrice des Ressources Humaines, Pr\u00e9sidente du CHSCT-M,<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">La cr\u00e9ation d\u2019un groupe de travail du CHSCT minist\u00e9riel a \u00e9t\u00e9 propos\u00e9 lors du comit\u00e9 de suivi RTT r\u00e9uni le 17 d\u00e9cembre 2015.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Le CHSCT-M du 25 janvier 2016 a donn\u00e9 un avis favorable \u00e0 la cr\u00e9ation de ce groupe de travail dont l&rsquo;intitul\u00e9 \u00ab\u00a0conditions de travail\u00a0\u00bb devait inclure en premier lieu des travaux sur les temps de travail, les charges de travail ainsi que le respect des garanties minimales de travail.<\/span><\/span><\/span><!--more--><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Les membres du CHSCT-M ont la volont\u00e9 d\u2019apporter des propositions et avis afin d\u2019am\u00e9liorer les conditions de travail des agent-e-s.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Ils ont aussi le devoir de rappeler sans cesse votre obligation de pr\u00e9server la sant\u00e9 physique et mentale des agent-e-s et qu\u2019en la mati\u00e8re vous avez une obligation de pilotage de la politique minist\u00e9rielle et de suivi des objectifs que vous aurez assign\u00e9s aux services et \u00e9tablissements publics de votre p\u00e9rim\u00e8tre minist\u00e9riel.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Les membres du CHSCT-M souhaitent que ce groupe de travail soit convoqu\u00e9 \u00e0 nouveau le plus rapidement possible.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Nous souhaitons qu\u2019il soit compos\u00e9 de 2 titulaires et 2 suppl\u00e9ants par organisation syndicale pr\u00e9sente au CHSCT-M.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Nous demandons que ce groupe de travail soit nomm\u00e9 \u00ab\u00a0temps et charges de travail\u00a0\u00bb<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Nous savons tous que les agent-e-s, y compris ceux plac\u00e9s sous la tutelle du Minist\u00e8re de l&rsquo;Environnement de l&rsquo;\u00e9nergie et de la mer, vivent des r\u00e9organisations importantes. Les postes et les conditions de travail s&rsquo;en trouvent boulevers\u00e9s. La baisse continue des effectifs et la d\u00e9sorganisation chronique du fonctionnement des services et op\u00e9rateurs, la perte de sens engendr\u00e9e par la remise en cause des missions, l\u2019absence de vision de long terme&#8230;, tout ceci contribue \u00e0 mettre en danger la sant\u00e9 des agent-e-s.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Les nouvelles technologies sont vues comme des outils facilitateurs des r\u00e9organisations (d\u00e9claration du 1er ministre aux cadres de la future DREAL Bourgogne \u2013 Franche-Comt\u00e9 le 13 novembre 2015) dans une conception de compensation ou de palliatif au manque de moyens et aux d\u00e9faillances de l\u2019organisation du travail.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Dans cette situation de fonctionnement en mode d\u00e9grad\u00e9, les services et op\u00e9rateurs organisent l\u2019allongement et l\u2019intensification du travail. Ils rendent invisible le temps de travail r\u00e9el. Les outils num\u00e9riques (smartphone, ordinateur, messagerie extranet..) ont largement contribu\u00e9 \u00e0 allonger et intensifier le travail r\u00e9el.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">L\u2019instruction de 2011 sur le temps de travail, les garanties minimales et les d\u00e9rogations pr\u00e9vues pour les situations de travail al\u00e9atoires et exceptionnelles ne sont pas respect\u00e9es.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\"><b>Nous voulons obtenir tous les \u00e9l\u00e9ments nous permettant de savoir si\u00a0:<\/b><\/span><\/span><\/span><\/p>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">les garanties minimales et le cadre des d\u00e9rogations pr\u00e9vues dans l\u2019instruction de 2011 sont respect\u00e9es.<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">tous les temps de travail sont comptabilis\u00e9s au-del\u00e0 du seul temps de travail effectif\u00a0: temps de d\u00e9placement, heures \u00e9cr\u00eat\u00e9es\u00a0, t\u00e9l\u00e9travail non d\u00e9clar\u00e9.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\"><b>Nous <span lang=\"fr-FR\">demandons<\/span> que\u00a0:<\/b><\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">un droit effectif \u00e0 la d\u00e9connexion soit mis en place<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<ul>\n<li>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">les charges de travail fassent l\u2019objet d\u2019une \u00e9valuation objective avec une prise en compte du travail r\u00e9ellement n\u00e9cessaire \u00e0 l&rsquo;atteinte des objectifs fix\u00e9s individuellement aux agents.<\/span><\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Les membres du CHSCT-M ont une r\u00e9elle volont\u00e9 d\u2019\u00eatre force de proposition.<\/span><\/span><\/span><\/p>\n<p align=\"JUSTIFY\"><span style=\"color: #000000\"><span style=\"font-family: Calibri, sans-serif\"><span style=\"font-size: medium\">Pour ce faire, ils ont besoin d\u2019obtenir tous les documents, donn\u00e9es et enqu\u00eates&#8230;
